CONTEST RULES - “Win a Netflix gift card worth 50,000 HUF” GAME

 

1. Duration of the Game

Kifli.hu Shop Kft. organizes a contest (hereinafter: Game) under the name “Win a Netflix gift card worth 50,000 HUF” from October 18, 2023, 00:00 to October 24, 2022, 23:59, the participation conditions of which are defined in these game rules (hereinafter: “Rules”).

 

2. Organizer and Executor of the Game

The organizer and executor of the Game is Kifli.hu Shop Kft. (headquarters: 1106, Budapest Jászberényi út 45; company registration number: 01 09 339560; tax number: 26693075-2-42) (“Organizer”).

 

3. Prizes of the Game

After the conclusion of the contest, the Organizer will determine 1 winner from all participating players, who will win a Netflix gift card (subscription) worth 50,000 HUF. The prize cannot be exchanged for cash or other products and is non-transferable.

 

4. Conditions for Participation in the Contest

4.1. These Rules apply to the Game and to all participants defined in point 4.2. The participant acknowledges that it is their duty to familiarize themselves with the provisions of the Rules before applying for the Game, and they cannot refer to the omission of this for gaining advantages, and this omission cannot be to the detriment of the Organizer or any other person possibly involved in the execution.

 

4.2. The Game is open to those who meet the following conditions: an adult, capable individual who has reached the age of 18, does not fall into the category of persons defined in point 4.4, has a valid Instagram registration, answers the question posed under the Game post in the form of a comment, in accordance with the conditions detailed in point 5, and simultaneously (automatically) accepts all conditions described in these Rules. If the Player does not meet any of the conditions set out in these Rules for any reason, the Organizer may exclude the affected Player from the Game. By participating in the Game, the Player acknowledges that they have fully understood and unconditionally accepted the conditions set out in these Rules. If the Player does not accept the conditions – in respect of any provision – the Organizer will exclude them from the Game. The Organizer reserves the right to exclude anyone from the Game without explanation in case of manipulation, irregular play, abuse, or suspicion thereof.

 

4.3. The Organizer excludes its liability for any technical problems, regardless of whether they arise in the IT system or service of the Player or the Organizer, or on the Facebook or Instagram social media sites.

 

4.4. Employees of Kifli.hu Shop Kft., third parties involved in the organization of the Game, subcontractors involved in the organization of the Game, and persons in employment or other legal relationships aimed at work with these persons, and their close relatives defined in Section 8:1 (1) 1 of the Civil Code cannot participate in the Contest.

 

4.5. By participating in the Game, the Player acknowledges that they have understood and accepted all conditions defined in the Rules. The Participant is responsible for ensuring that the personal data provided during the Game is accurate and remains accurate throughout the duration of the Game. The Organizer excludes all liability for any inaccuracies or errors in the personal data provided during the Game.

 

5. Procedure for Participation in the Contest

5.1.The game is exclusively available on the Kifli.hu website.

between October 18, 2023, 00:00 and October 24, 2022, 23:59, they automatically register themselves for the game.

 

5.3. The winners will be selected based on the conditions outlined in point 5.2, who have a Kifli.hu user account and live within the Kifli.hu delivery area.

 

5.4. The Organizer will draw 1 winner after the conclusion of the game. The draw is not public and is conducted through the website https://www.random.org/.

 

5.5. The Organizer will notify the winners of their prize via email. If the winner does not respond within 2 working days of the notification, the Organizer will draw a new winner.

 

6. Prize Collection

6.1. The winning Players must contact the Organizer within 2 working days of the notification and provide their full name, address, phone number, and email address to which the Organizer will send the prize.

 

6.2. The Organizer will notify the winning player via the registered email address.

 

6.3. The alternate winner becomes eligible for the Prize if the winner does not meet any personal and/or material conditions described in these Rules, and thus the Organizer excludes them from the game, or the winner renounces their prize. The alternate winner will not be publicly disclosed by Kifli.hu.

 

6.4. Participation in the contest and the provision of the necessary personal data is voluntary. The condition for participation in the contest is that the player accepts the data management statement, which the player automatically accepts by submitting their application. The Organizer guarantees that data management is carried out in full compliance with the applicable legal provisions. The Organizer provides the Participant with the opportunity to request information about the handling of their personal data, request its deletion or correction through a private message sent to the Kifli.hu Instagram page. In addition, the Participant has the right to object to the handling of their personal data. The Participant acknowledges that if they submit their objection statement regarding their name and contact details before the deadline specified in point 1, they cannot participate in the game, as the identification of the winner would not be possible in this case. By participating in the game, the Participants acknowledge and expressly consent to the Organizer using their name and all data provided during the Game for the purpose of determining the winning Participant and notifying them via electronic message, and that the Organizer and/or its agent may publicly disclose the winner's name exclusively in connection with the Game without any further conditions or compensation if justified or necessary.

 

6.5. Any costs (e.g., requesting extra services) and expenses incurred in connection with the use of the prize are borne by the Winner.

 

7. Data Protection

7.2. Purpose and legal basis of data management

By participating in the Game, the Player consents to the handling of their previously provided data on the website for the following data management purposes, and the following legal basis arises: Managed data and the name of data management: the username, full name, address, phone number, and email address of the Player participating in the Game. The purpose of data management: the execution of the Game, including the draw and contact. Ensuring transparency, filtering out multiple registrations. Interest balancing based on the legitimate interest of Kifli.hu Shop Kft. and players, legitimate interest: fairness of the game, ensuring equal chances. Fair execution of the Game, preventing abuses. The legal basis of data management: the consent of the affected person. Administration related to the winner, handing over the prize, fulfilling tax payment obligations related to the prize based on Act XCII of 2003 on the order of taxation, Act C of 2000 on accounting, and Act CXVII of 1995 on personal income tax.

 

7.3. Data retention period The data received during the Game is managed by the data controller exclusively until the goal is achieved and for the period defined by law. Duration: the duration of the Game and the following 6 months. The organizer notifies the winners via Instagram message. 8. Liability

Kifli.hu Shop Kft. does not assume responsibility for any deficiencies in the applications (full name, address, phone number, email address errors, fewer responses, etc.), notification, or other delays. Players bear all consequences arising from the incorrect data they provide or the inability of their mailbox to receive messages. Kifli.hu Shop Kft. generally cannot verify the accuracy of the data during (or after) the application for the Game. Responsibility and all legal and financial consequences related to this always lie solely with the Players. Kifli.hu Shop Kft. excludes all liability for any compensation claims arising from participation in the Games, the possible errors, deficiencies, malfunctioning of the Game, delays during the Game, or related costs, damages, losses. By participating in the Game, the Player expressly waives any claims against Kifli.hu Shop Kft. or any third party related to the execution of the Game, the draw, the prizes, the winners. Kifli.hu Shop Kft. does not assume any responsibility for the accuracy, reliability, error-free operation, completeness, suitability for a given purpose of the Game. Kifli.hu Shop Kft. also does not assume responsibility if the Game, or the website containing the Game and these Rules, is temporarily unavailable for technical reasons during the duration of the Game. Kifli.hu Shop Kft. is also not responsible for errors and their consequences arising from reasons beyond its control (such as technical failures or outages in the Internet network). The Player is solely responsible for the content submitted during the Game. Kifli.hu Shop Kft. excludes all liability for any property or non-property damage, legal infringement, or other consequences related to the content submitted, published, or otherwise made public by the Player during the Game. The Player guarantees that no personal representation appears in the image. If any third party or authority, or court raises any claim or initiates proceedings against Kifli.hu Shop Kft. due to the Player's conduct or in connection with it, the Player is obliged to take all measures required by Kifli.hu Shop Kft. and compensate Kifli.hu Shop Kft. for all damages, property disadvantages, and costs (including compensation for grievances) incurred by Kifli.hu Shop Kft. due to the Player's illegal conduct or in connection with it.

 

9. Final Provisions

9.1 The Organizer reserves the right to unilaterally modify or terminate the conditions set out in these Rules or the Game itself, even during its duration. The Organizer will publish the modifications to the rules or the notification of the possible termination of the Game in the comment used to announce the Game before the modification or termination. It is the responsibility of the Players registering for the Game to properly inform themselves about these. Any decision of the Organizer related to the Game is final and binding in all respects, and no legal action can be initiated regarding them.

 

9.2 The Organizer declares and undertakes that if any disputed question arises regarding the use of the Prize, it will try to resolve them primarily through negotiations and agreements with the Participants. In any disputed question, the decision of the Organizer is authoritative.

 

9.3 Promotions launched on the Kifli.hu Facebook page or Instagram profile are independent of Facebook and Instagram; Facebook does not support them and does not participate in them, the Game is launched exclusively by the Organizer. During the use of the Game, the business rules of the Player's internet service provider, as well as the rules of Facebook and Instagram, remain unchanged. The Player acknowledges that the message and data transmission, as well as response speed, depend on the technical conditions of the server, and neither the Organizer nor the Executor assumes responsibility for this. The above may be adversely affected by network congestion and other factors beyond the control of the Organizer and its partners, such as (but not limited to) network congestion, coverage, connection errors, device performance, and maintaining a secure network connection.
