CONTEST RULES – Zewa XXL contest

 

1. Duration of the Contest

Kifli.hu Shop Kft. organizes a contest named Zewa XXL contest between February 21, 2024, 00:00 and February 27, 2024, 23:59, the participation conditions of which are defined in these contest rules (hereinafter referred to as “Rules”).

 

2. Organizer and Executor of the Contest

The organizer and executor of the Contest is Kifli.hu Shop Kft. (headquarters: 1106 Budapest, Jászberényi út 45.; company registration number: 01-09-339560; tax number: 26693075-2-44.) (“Organizer”).

 

3. Prizes of the Contest

After the conclusion of the contest, the Organizer will draw 10 winners from those who purchased at least 1 Zewa Deluxe XXL toilet paper (https://www.kifli.hu/94659), who will win Kifli credits worth 10,000 HUF.

The prize cannot be exchanged for cash or other products and is non-transferable.

 

4. Conditions for Participation in the Contest

4.1. These Rules apply to the Zewa XXL contest and to all participants defined in point 4.2. The participant acknowledges that it is their responsibility to familiarize themselves with the provisions of the Rules before entering the Zewa XXL contest, and they cannot refer to the lack of knowledge of the Rules to gain advantages, and this omission cannot be to the detriment of the Organizer or any other person possibly involved in the execution.

4.2. Anyone who meets the following conditions can participate in the Contest: an adult, capable individual who has reached the age of 18, does not fall into the category of persons defined in point 4.4, and during the contest period purchases at least 1 Zewa Deluxe XXL toilet paper (https://www.kifli.hu/94659), and simultaneously (automatically) accepts all conditions described in these Rules.

If the Participant does not meet the conditions set out in these Contest Rules for any reason, the Organizer may exclude the affected Participant from the Contest.

By participating in the Contest, the Participant acknowledges that they have fully understood the conditions set out in these Contest Rules and accepted them unconditionally. If the Participant does not accept the conditions – in respect of any provision – the Organizer will exclude them from the Contest. The Organizer reserves the right to exclude anyone from the Contest without explanation in case of manipulation, irregular play, abuse, or suspicion thereof.

4.3. The Organizer excludes its liability for any technical problems, regardless of whether they arise in the Participant's or the Organizer's IT system, or in the services, or on Facebook or Instagram social media sites.

4.4. Employees of Kifli.hu Shop Kft., as well as other third parties involved in the organization of the Zewa XXL contest and subcontractors involved in the organization of the Zewa XXL contest, and persons in employment or other legal relationships aimed at work performance with these subcontractors, and their close relatives defined in Section 8:1.§ (1) 1. of the Civil Code cannot participate in the Contest.

4.5. By participating in the Contest, the Participant acknowledges that they have understood the Rules and accept all conditions defined therein. The Participant is responsible for ensuring that the personal data provided during the contest are accurate and remain valid throughout the duration of the Zewa XXL Contest. The Organizer excludes all liability for any inaccuracies or errors in the personal data provided during the contest.

 

5. Procedure for Participation in the Contest

5.1.The contest is exclusively available on the Kifli.hu website (https://www.kifli.hu/).

5.2. The Participant can participate in the contest by logging into their Kifli user account and purchasing at least 1 Zewa Deluxe XXL toilet paper (https://www.kifli.hu/94659) on the Kifli.hu website.

5.4. The winners will be selected from customers who have a Kifli.hu user account and live in Budapest and its surroundings or in our Balaton delivery areas.

5.5. After the conclusion of the contest, the Organizer will draw 10 (ten) winners. The draw is not public and takes place through the https://random.org website.

5.6. The Organizer will notify the winners of their prize via email. If the winner does not respond within 2 working days from the notification, the Organizer will draw a new winner.

 

6. Prize Collection

6.1. The winning Participants must contact the Organizer within 2 working days from the notification and provide their full name, address, phone number, and email address.

6.2. The Organizer will coordinate the details of the prize usage with the winner with the cooperation of Essity Hungary Kft., the prize sponsor.

6.3. The alternate winner becomes eligible for the Prize if the winner does not meet any personal and/or material conditions described in these Contest Rules and is thus excluded from the contest by the Organizer, or if the winner renounces the prize. The alternate winner will not be publicly disclosed by the Kifli.hu Organizer.

6.4. Participation in the contest and the provision of the necessary personal data are voluntary. Participation in the contest requires the participant to accept the data management statement, which the participant automatically accepts by submitting their application. The Organizer guarantees that data management is carried out in full compliance with the applicable legal provisions.

The Organizer always provides the Participant with the opportunity to request information about the handling of their personal data, request their deletion or correction via email sent to the Kifli.hu customer service. In addition, the Participant has the right to object to the handling of their personal data. The Participant acknowledges that if they submit a prohibition statement regarding their name and contact details before the deadline specified in point 1, they cannot participate in the contest, as it would be impossible to identify the winner in this case.

By participating in the contest, the Participants acknowledge and expressly consent to the Organizer using the Participants' names and all data provided during the Contest for the purpose of determining the winning Participant and notifying them via electronic message, and the Organizer and/or its agent may publicly disclose the winner's name exclusively in connection with the contest without any further conditions or compensation if justified or necessary.

6.5. Any costs (e.g., requesting extra services) and expenses related to the use of the prize are borne by the Winner.

 

7. Data Protection

The handling of the Participants' personal data is governed by this Unique Data Management Information. Issues not regulated here are detailed in the Organizer's Data Management Information https://kifli.hu/oldal/szemelyes-adatkezelesi-alapelvek.

7.2. Purpose and Legal Basis of Data Management

By participating in the Contest, the Participant consents to the handling of the data provided during the registration on the website for the following data management purposes, and the following legal basis arises:

Managed data and name of data management: the username, full name, address, phone number, and email address of the Participant in the Contest.

Purpose of data management: the execution of the Contest, including the draw and contact. Ensuring transparency, filtering out multiple registrations. Interest balancing based on the legitimate interest of Kifli.hu Shop Kft. and the participants, legitimate interest: fairness of the contest, ensuring equal chances. Fair execution of the Contest, preventing abuses.

Legal basis of data management: the consent of the affected person

Administration related to the winner, handing over the prize, fulfilling tax obligations related to the prize based on Act XCII of 2003 on the order of taxation, Act C of 2000 on accounting, and Act CXVII of 1995 on personal income tax.

7.3. Retention Period of Data

The data received during the Contest are managed by the data controller exclusively until the realization of the purpose and for the period defined by law. The following table shows the duration of data management:

Managed data: The username and full name, address, phone number, and email address of the Participant in the Contest.

Duration: the duration of the Contest and the following 6 months

The Organizer will notify the winners via email.

Handling of the winner's data (full name, address, phone number, email address; if necessary, tax number/tax identification number)

Information about the data management practices of Kifli.hu Shop Kft., the data management claims of the Participants (Claim enforcement address: 1111 Budapest, Lágymányosi utca 12. fszt. 2.), and other data management conditions not regulated in these Rules are detailed in the General Data Management Rules (https://kifli.hu/oldal/szemelyes-adatkezelesi-alapelvek).

 

8. Liability

The Organizer does not assume responsibility for any deficiencies in the applications (incorrect full name, address, phone number, email address, fewer responses, etc.), notification, or other delays. The Participants bear all consequences arising from the incorrect data they provided or the inability of their mailbox to receive messages. The Organizer generally cannot verify the accuracy of the data during the application for the Contest (or afterwards). In this regard, the responsibility and all related legal and financial consequences are exclusively borne by the Participants. The Organizer excludes all liability for any compensation claims arising from participation in the Contest, any errors, deficiencies, malfunctions, delays during the Contest, or any related costs, damages, or losses. By participating in the Contest, the Participant expressly waives any claims against the Organizer or any third party related to the execution of the Contest, the draw, the prizes, or the winners.

The Organizer does not assume any responsibility for the accuracy, reliability, error-free operation, completeness, or suitability for a specific purpose of the Contest. The Organizer also does not assume responsibility if the Contest or the website containing the Contest and these Rules is temporarily unavailable for technical reasons during the Contest period. The Organizer is not responsible for any errors and their consequences arising from technical failures or outages in the Internet network.

The Participant is solely responsible for the content submitted during the Contest. The Organizer excludes all liability for any material or non-material damage, legal infringement, or other consequences related to the content submitted, published, or otherwise made public by the Participant during the Contest. The Organizer guarantees that no personal representation appears in the image.

If a third party or any authority or court makes any claim or initiates proceedings against the Organizer due to the Participant's conduct or in connection with it, the Participant is obliged to take all measures required by the Organizer and compensate the Organizer for all damages, material disadvantages, and costs (including compensation for damages) incurred by the Organizer due to the Participant's illegal conduct or in connection with it.

 

9. Final Provisions

9.1 The Organizer reserves the right to unilaterally modify or terminate the conditions set out in these Contest Rules or the Contest itself, even during its duration. The Organizer will publish the modifications to the Rules or the notification of the possible termination of the Contest in the comment used to announce the Contest before the modification or termination. It is the responsibility of the Participants registering for the Contest to properly inform themselves about these. Any decision of the Organizer related to the Contest is final and binding in all respects, and no legal action can be initiated in connection with them.

9.2 The Organizer declares and undertakes that if any disputed issue arises regarding the use of the Prize, it will try to resolve it primarily through negotiations and agreements with the Participants.

In any disputed matter, the decision of the Organizer is decisive.

9.3 Promotions launched on the Kifli.hu Facebook page or Instagram profile are independent of Facebook and Instagram; Facebook does not support or participate in them, the Contest is launched exclusively by the Organizer. During the use of the Contest, the business rules of the Participant's internet service provider, as well as the rules of Facebook and Instagram, remain unchanged. The Participant acknowledges that the message and data transmission speed depends on the technical conditions of the server, and therefore neither the Organizer nor the Executor assumes responsibility. The above may be adversely affected by network congestion and other factors beyond the control of the Organizer and its partners, such as (but not limited to) network congestion, coverage, connection errors, device performance, and maintaining a secure network connection.
