CONTEST RULES – Syoss Mix & Match contest

 

1. Duration of the Contest

Kifli.hu Shop Kft. organizes a contest under the name Syoss Mix & Match from February 21, 2024, 00:00 to February 27, 2024, 23:59, the participation conditions of which are defined in these contest rules (hereinafter: "Rules").

 

2. Organizer and Executor of the Contest

The organizer and executor of the Contest is Kifli.hu Shop Kft. (headquarters: 1106 Budapest, Jászberényi út 45.; company registration number: 01-09-339560; tax number: 26693075-2-44.) ("Organizer").

 

3. Prizes of the Contest

After the conclusion of the contest, the Organizer will draw 6 winners from those who purchased at least 3 Syoss products in a multibuy promotion, who will win Kifli credits worth 20,000 HUF.

The prize cannot be exchanged for cash or other products and is non-transferable.

 

4. Conditions for Participation in the Contest

4.1. The scope of these Rules extends to the Syoss Mix & Match contest and all participants defined in point 4.2. The participant acknowledges that it is their responsibility to familiarize themselves with the provisions of the Rules before entering the Syoss Mix & Match contest, and they cannot claim any advantages from failing to do so, nor can this omission be to the detriment of the Organizer or any other person possibly involved in the execution.

4.2. Participation in the Contest is open to those who meet the following conditions: an adult over the age of 18, a legally competent individual, not falling within the group of persons defined in point 4.4, and during the contest period, purchase at least 3 Syoss products in a multibuy promotion, and simultaneously (automatically) accept all conditions described in these Rules.

If the Participant does not meet the conditions set out in these Contest Rules for any reason, the Organizer may exclude the affected Participant from the Contest.

By participating in the Contest, the Participant acknowledges that they have fully understood and unconditionally accepted the conditions set out in these Contest Rules. If the Participant does not accept the conditions – in respect of any provision – the Organizer will exclude them from the Contest. The Organizer reserves the right to exclude anyone from the Contest without explanation in case of manipulation, irregular play, abuse, or suspicion thereof.

4.3. The Organizer excludes liability for any technical problems, regardless of whether they arise in the Participant's or the Organizer's IT system or service, or on the Facebook or Instagram social media platforms.

4.4. Employees of Kifli.hu Shop Kft., as well as other third parties involved in organizing the Syoss Mix & Match contest, subcontractors involved in organizing the Syoss Mix & Match contest, and persons in employment or other legal relationships aimed at work performance with these, and their close relatives as defined in Section 8:1 (1) 1 of the Civil Code, cannot participate in the Contest.

4.5. By participating in the contest, the Participant acknowledges that they have understood the Rules and accept all conditions defined therein. The Participant is responsible for ensuring that the personal data provided during the contest is accurate and remains valid throughout the entire duration of the Syoss Mix & Match Contest. The Organizer excludes all liability for any inaccuracies or errors in the personal data provided during the contest.

 

5. Procedure for Participation in the Contest

5.1.The contest is exclusively available on the Kifli.hu website (https://www.kifli.hu/).

5.2. After logging into their own Kifli user account, the Participant can participate in the contest by purchasing at least 3 Syoss products in a multibuy promotion on the Kifli.hu website.

5.4. The winners will be selected from customers who have a Kifli.hu user account and live in Budapest and its surroundings or in our Balaton delivery areas.

5.5. After the conclusion of the contest, the Organizer will draw 6 (six) winners. The draw is not public and is conducted through the https://random.org website.

5.6. The Organizer will notify the winners of their prize via email. If the winner does not respond within 2 working days of the notification, the Organizer will draw a new winner.

 

6. Prize Collection

6.1. The winning Participants must contact the Organizer within 2 working days of notification and provide their full name, address, phone number, and email address to the Organizer.

6.2. The Organizer will coordinate the details of prize usage with the winner in collaboration with Henkel Magyarország Kft., the prize sponsor.

6.3. The alternate winner becomes eligible for the Prize if the winner does not meet any personal and/or material conditions described in these Contest Rules, and thus the Organizer excludes them from the contest, or if the winner renounces their prize. The alternate winner will not be publicly announced by the Kifli.hu Organizer.

6.4. Participation in the contest and the provision of personal data necessary for it is voluntary. Participation in the contest is conditional upon the participant accepting the data management statement, which the participant automatically accepts by submitting their application. The Organizer guarantees that data management is carried out in full compliance with the applicable legal provisions.

The Organizer provides the Participant with the opportunity to request information about the handling of their personal data, request its deletion or correction via email sent to Kifli.hu customer service. In addition, the Participant has the right to object to the handling of their personal data. The Participant acknowledges that if they make a statement of objection regarding their name and contact details before the deadline specified in point 1, they cannot participate in the contest, as in this case, the winner cannot be identified.

By participating in the contest, Participants acknowledge and expressly consent to the Organizer using their name and all data provided during the Contest for the purpose of determining the winning Participant and notifying them via electronic message, and to the Organizer and/or its agent publicly disclosing the winner's name exclusively in connection with the contest, if justified or necessary.

6.5. Any costs and expenses that may arise in connection with the use of the prize (e.g., requesting extra services) are the responsibility of the Winner.

 

7. Data Protection

The handling of Participants' personal data is governed by this Unique Data Management Information. Issues not regulated here are detailed in the data management information of the contest organizer https://kifli.hu/oldal/szemelyes-adatkezelesi-alapelvek.

7.2. Purpose and Legal Basis of Data Management

During participation in the Contest, the Participant consents to the handling of their previously provided data during registration on the website for the following data management purposes, and the following legal basis arises:

Managed Data and Data Management Description: the username, full name, address, phone number, and email address of the Participant in the Contest.

Purpose of Data Management: conducting the Contest, including the draw and communication. Ensuring transparency, filtering out multiple registrations. Balancing of interests based on the legitimate interest of Kifli.hu Shop Kft. and players, legitimate interest: fairness of the contest, ensuring equal opportunities. Fair conduct of the Contest, preventing abuse.

Legal Basis of Data Management: the consent of the data subject

Administration related to the winner, delivery of the prize, fulfillment of tax obligations related to the prize is based on Act XCII of 2003 on the order of taxation, Act C of 2000 on accounting, and Act CXVII of 1995 on personal income tax.

7.3. Data Retention Period

The data received during the Contest is managed by the data controller exclusively until the purpose is achieved and for the period specified by law. The following table shows the duration of data management:

Managed Data: The username and full name, address, phone number, and email address of the Participant in the Contest.

Duration: the duration of the Contest and 6 months thereafter

The winners are notified by the organizer via email message.

Handling of winner's data (full name, address, phone number, email address; if necessary, tax number/tax identification number)

Kifli.hu Shop Kft.'s data management practices, data management claims available to Participants (Claim Enforcement Address: 1111 Budapest, Lágymányosi utca 12. ground floor 2.) and other data management conditions not regulated in these Rules are governed by the General Data Management Rules (https://kifli.hu/oldal/szemelyes-adatkezelesi-alapelvek).

 

8. Liability

Kifli.hu Shop Kft. is not responsible for any deficiencies in applications (full name, address, phone number, email address errors, fewer responses, etc.), notification, or other delays. Participants bear all consequences arising from data they provided incorrectly or from their mailbox being unable to receive messages. Kifli.hu Shop Kft. generally cannot verify the accuracy of data during (or after) registration for the Contest. In this regard, responsibility and all related legal and financial consequences are solely borne by the Participants. Kifli.hu Shop Kft. excludes all liability for any claims for damages or compensation arising from participation in the Contest, from any errors, deficiencies, or malfunctions in the Contest, or from costs, damages, or losses related to or arising from delays during the Contest. By participating in the Contest, the Participant expressly waives any claims against Kifli.hu Shop Kft. or any third party related to the conduct of the Contest, the draw, the prizes, or the winners.

Kifli.hu Shop Kft. assumes no responsibility for the accuracy, reliability, error-free operation, completeness, or suitability for a particular purpose of the Contest. Kifli.hu Shop Kft. also assumes no responsibility if the Contest or the website containing the Contest and these Rules is temporarily unavailable for technical reasons during the Contest period. Kifli.hu Shop Kft. is not responsible for errors and their consequences arising from reasons beyond its control (such as technical failures or outages in the Internet network).

The Participant is solely responsible for the content submitted during the Contest. Kifli.hu Shop Kft. excludes all liability for any material or non-material damage and legal violations, or other consequences related to the content submitted, published, or otherwise made public by the Participant during the Contest, or otherwise related to the Participant's conduct. It guarantees that no personal representation appears in the image.

If, as a result of the Participant's conduct or in connection with it, any third party or any authority or court makes any claim or initiates proceedings against Kifli.hu Shop Kft., the Participant is obliged to take all measures required by Kifli.hu Shop Kft. and to compensate Kifli.hu Shop Kft. for any damage, financial disadvantage, and costs (including compensation for damages) incurred by Kifli.hu Shop Kft. due to any unlawful conduct of the Participant or in connection with it.

 

9. Final Provisions

9.1 The Organizer reserves the right to unilaterally modify or terminate the conditions set out in these Contest Rules or the Contest itself, even during its duration. The Organizer will publish the modifications to the rules or the notification of the possible termination of the Contest in the comment announcing the Contest. It is the responsibility of the Participants registering for the Contest to properly inform themselves about these. Any decision by the Organizer related to this Contest is final and binding in all respects, and no legal action can be initiated in connection with them.

9.2 The Organizer declares and undertakes that if a dispute arises regarding the use of the Prize, it will attempt to resolve it primarily through negotiation and agreement with the Participants.

In any dispute, the Organizer's decision is decisive.

9.3 Promotions launched on the Kifli.hu Facebook page or Instagram profile are independent of Facebook and Instagram; Facebook does not support or participate in them, the Contest is initiated solely by the Organizer. During the use of the Contest, the business rules of the Participant's internet service provider, as well as the rules of Facebook and Instagram, remain applicable. The Participant acknowledges that the speed of message and data transmission, as well as response, depends on the technical conditions of the server, and therefore neither the Organizer nor the Executor assumes responsibility. The above may be adversely affected by network congestion and other factors beyond the control of the Organizer and its partners, such as (but not limited to) network congestion, coverage, connection errors, device performance, and maintaining a secure network connection.
