CONTEST RULES - “Win Tickets to the Csak a mentes Festival” GAME

 

1. Duration of the Game
The Kifli.hu Shop Kft. organizes a contest called “Win Tickets to the Csak a mentes Festival” (hereinafter: Game) between December 1, 2023, 19:00 and December 6, 2023, 23:59, the participation conditions of which are defined in these game rules (hereinafter: “Rules”).

2. Organizer and Executor of the Game
The organizer and executor of the Game is Kifli.hu Shop Kft. (headquarters: 1106, Budapest Jászberényi út 45; company registration number: 01 09 339560; tax number: 26693075-2-42) (“Organizer”).

3. Prizes of the Game
After the conclusion of the contest, the Organizer will determine 5 winners among all participating players, who, along with one companion each (10 tickets in total), can attend the Csak a mentes Festival held at RaM ArT Theatre (1133 Bp., Kárpát utca 23.) on December 9 and 10, 2023. The prize cannot be exchanged for cash or other products and is non-transferable.

4. Conditions for Participation in the Contest
4.1. These Rules apply to the Game and all participants defined in point 4.2. The participant acknowledges that it is their responsibility to familiarize themselves with the provisions of the Rules before entering the Game, and they cannot claim any advantages from failing to do so, nor can this omission be to the detriment of the Organizer or any other person possibly involved in the execution.
4.2. Participation in the Game is open to those who meet the following conditions: an adult over the age of 18, legally competent individual, not falling within the scope of persons defined in point 4.4, and has a valid Instagram registration, responds to the question posed under the Game post in the form of a comment, in accordance with the conditions detailed in point 5, and simultaneously (automatically) accepts all conditions described in these Rules. If the Player does not meet any of the conditions set out in these Game Rules for any reason, the Organizer may exclude the affected Player from the Game. By participating in the Game, the Player acknowledges that they have fully understood and unconditionally accepted the conditions set out in these Game Rules. If the Player does not accept the conditions – in respect of any provision – the Organizer will exclude them from the Game. The Organizer reserves the right to exclude anyone from the Game without explanation in case of manipulation, irregular play, abuse, or suspicion thereof.
4.3. The Organizer excludes liability for any technical problems, regardless of whether they arise in the Player's or the Organizer's IT system or service, or on the Facebook or Instagram social media platforms.
4.4. Employees of Kifli.hu Shop Kft., as well as other third parties involved in organizing the Game and subcontractors involved in organizing the Game, and persons in employment or other legal relationships aimed at work with these persons, and their close relatives as defined in Section 8:1 (1) 1 of the Civil Code, cannot participate in the Contest.
4.5. By participating in the Game, the Player acknowledges that they have understood and accepted all conditions defined in the Rules. The Participant is responsible for ensuring that the personal data provided during the game is accurate and remains so throughout the entire duration of the Game. The Organizer excludes all liability for any inaccuracies or errors in the personal data provided during the game.

5. Procedure for Participation in the Contest
5.1.The game is exclusively available on Instagram, on the Kifli.hu Instagram page https://www.instagram.com/kifli_szupermarket/
5.2. After logging into their own Instagram (www.instagram.com) user page, the Player can participate in the contest through the game created in the post published on the Kifli.hu Instagram page on September 11, 2023.
5.3. The Kifli.hu Instagram page invites visitors to respond to the question posed in the post in the form of a comment, under the post. With this request, the Organizer announces a game through the https://www.instagram.com/kifli_szupermarket/ page among the users of the instagram.com site.
5.4. Winners will be selected from among the commenters who have a Kifli.hu user account and live within the Kifli.hu delivery area.
5.5. After the conclusion of the game, the Organizer will draw 5 winners (+1 companion each). The draw is not public and is conducted through the https://commentpicker.com/ site.
5.6. The Organizer will notify the winners of their prize via private message on Instagram. If the winner does not respond within 2 business days of notification, the Organizer will draw a new winner.

6. Prize Collection
6.1. Winners must contact the Organizer within 2 business days of notification and provide their full name, address, phone number, and email address, to which the Organizer will send the prize.
6.2. The Organizer will notify the winning player via private message on their Instagram profile and mention them under the contest post.
6.3. The alternate winner becomes eligible for the Prize if the winner does not meet any personal and/or material conditions described in these Game Rules, and thus the Organizer excludes them from the game, or if the winner renounces their prize. The Organizer will not disclose the alternate winner on the Kifli.hu Instagram page.
6.4. Participation in the contest and the provision of personal data required for it is voluntary. Participation in the contest is conditional upon the player accepting the data management statement, which the player automatically accepts by submitting their application. The Organizer guarantees that data management is carried out in compliance with all applicable legal provisions. The Organizer provides the Participant with the opportunity to request information about the handling of their personal data, request its deletion or correction via a private message sent to the Kifli.hu Instagram page. In addition, the Participant has the right to object to the processing of their personal data. The Participant acknowledges that if they make a prohibition statement regarding their name and contact details before the deadline specified in point 1, they cannot participate in the game, as in this case, it is not possible to identify the winner. By participating in the game, Participants acknowledge and expressly consent to the Organizer using their name and all data provided during the Game for the purpose of determining the winning Participant and notifying them via electronic message, and to the Organizer and/or its agent publicly disclosing the winner's name exclusively in connection with the Game, if justified or necessary.
6.5. Any costs and expenses that may arise in connection with the use of the prize (e.g., requesting extra services) are the responsibility of the Winner.

7. Data Protection
The handling of Players' personal data is governed by this Unique Data Management Information. Questions not regulated here are detailed in the data management information of the game organizer

7.2. Purpose and Legal Basis of Data Management
During participation in the Game, the Player consents to the handling of their previously provided data on the website for the following data management purposes, and the following legal basis arises: Managed data and the name of data management: the username, full name, address, phone number, and email address of the Player participating in the Game. The purpose of data management: conducting the Game, including the draw and contact. Ensuring transparency, filtering out multiple registrations. Based on the legitimate interest of Kifli.hu Shop Kft. and players, legitimate interest: fairness of the game, ensuring equal opportunities. Fair conduct of the Game, preventing abuse. The legal basis for data management: the consent of the data subject. Administration related to the winner, delivery of the prize, fulfillment of tax obligations related to the prize based on Act XCII of 2003 on the order of taxation, Act C of 2000 on accounting, and Act CXVII of 1995 on personal income tax.
7.3. Data Retention Period The data received during the Game is managed by the data controller exclusively until the purpose is achieved and for the period specified by law. The following table shows the duration of data management: Managed data: The username and full name, address, phone number, and email address of the Player participating in the Game. Duration: the duration of the Game and 6 months thereafter. The organizer notifies the winners via Instagram message. Management of the winner's data (full name, address, phone number, email address; if necessary, tax number/tax identification number) The Kifli.hu Shop Kft.'s data management practices, data management claims available to Players (Claim enforcement address: 1106 Budapest, Jászberényi út 45.) and other data management conditions not regulated in these Rules are provided in the General Data Management Rules (https://kifli.hu/oldal/szemelyes-adatkezelesi-alapelvek).

8. Liability
Kifli.hu Shop Kft. assumes no responsibility for any deficiencies in applications (full name, address, phone number, email address errors, fewer responses, etc.), notification, or other delays. Players bear all consequences arising from incorrectly provided data or the inability of their mailbox to receive messages. Kifli.hu Shop Kft. generally cannot verify the accuracy of the data during (or after) the application for the Game. In this regard, responsibility and all related legal and financial consequences are solely borne by the Players. Kifli.hu Shop Kft. excludes all liability for any claims for damages or compensation arising from participation in the Games, any errors, deficiencies, malfunctions, delays during the Game, or costs, damages, or losses related to or arising from them. By participating in the Game, the Player expressly waives any claims against Kifli.hu Shop Kft. or any third party related to the conduct of the Game, the draw, the prizes, the winners. Kifli.hu Shop Kft. assumes no responsibility for the accuracy, reliability, error-free operation, completeness, or suitability for a particular purpose of the Game. Kifli.hu Shop Kft. also assumes no responsibility if the Game or the website containing the Game and these Rules is temporarily unavailable for technical reasons during the Game period. Kifli.hu Shop Kft. is not responsible for errors and their consequences arising from reasons beyond its control (e.g., technical failure or outage in the Internet network). The Player is solely responsible for the content submitted during the Game. Kifli.hu Shop Kft. excludes all liability for any material or non-material damage and legal injury, or other consequences related to the content submitted or published by the Player, or otherwise made public in connection with the Game, or otherwise related to the Player's conduct. It guarantees that no personal representation appears in the image. If, as a result of the Player's conduct or in connection with it, any third party or any authority or court makes any claim or initiates proceedings against Kifli.hu Shop Kft., the Player is obliged to take all measures required by Kifli.hu Shop Kft. and to compensate Kifli.hu Shop Kft. for any damage, financial disadvantage, and cost (including compensation for damages) incurred by Kifli.hu Shop Kft. due to any illegal conduct of the Player or in connection with it.

9. Final Provisions
9.1 The Organizer reserves the right to unilaterally modify or terminate the conditions set out in these Game Rules or the Game itself, even during its duration. The Organizer will publish the amendments to the rules or the notification of the possible termination of the Game in the comment announcing the Game before the modification or termination. It is the responsibility of the Players registering for the Game to properly inform themselves about these. Any decision of the Organizer related to this Game is final and binding in all respects, and no legal action can be initiated in connection with them.
9.2 The Organizer declares and undertakes that if a dispute arises regarding the use of the Prize, it will attempt to resolve it primarily through negotiation and agreement with the Participants. In any dispute, the Organizer's decision is decisive.
9.3 Promotions launched on the Kifli.hu Facebook page or Instagram profile are independent of Facebook and Instagram; Facebook does not support or participate in them, the Game is initiated solely by the Organizer. During the use of the Game, the business rules of the Player's internet service provider, as well as the rules of Facebook and Instagram, remain applicable. The Player acknowledges that the speed of message and data transmission, as well as response, depends on the technical conditions of the server, and neither the Organizer nor the Executor assumes responsibility for this. The above may be adversely affected by network congestion and other factors beyond the control of the Organizer and its partners, such as (but not limited to) network congestion, coverage, connection errors, device performance, and maintaining a secure network connection.
